Cox Law secures another COVID Vaccine employment termination win
FOR IMMEDIATE RELEASE:
Cox Law (https://coxlawcenter.com ) secures another COVID Vaccine employment termination win, here an Appellate Victory in [Anonymous], et al v. UNIVERSITY OF MARYLAND …, et al.
The Appellate Court of Maryland rightly reversed and remanded a Cox Law client’s vaccine discrimination case to the Circuit Court, overturning the County Judge’s dismissal with prejudice, and permitting the case to move forward with amendment on religious and medical discrimination and retaliation. In its unpublished ruling, the Court hinted (interestingly) that “Bible study” inquiry by the State into the employee’s faith for a religious exemption, which we argued was expressly impermissible under the Constitution, could be proper if it was instead a “mere inquiry”:
“We are further unpersuaded with [the] argument that the State may not hold “Bible studies” to determine their [sic] approval of [the employee’s] religion. Mere inquiry into the relationship between the religious beliefs, practices, and its connection to an employment discrimination claim is often considered by courts in survival of a motion to dismiss.”
We thank the Lord for this victory and look forward to the fight. Our client is to be honored for perseverance and bravery to stand up for all Marylanders in defense of religious freedom.
Attorney Dan Cox thanks Attorney Ed Hartman for his assistance at Oral Argument in this victory.
